An elderly Cole Harbour, N.S., man has died before he could be tried for murder in the death of his wife.
The Crown formally withdrew the first-degree murder charge against Edmund Joseph Organ, 79, during a brief appearance Monday in Nova Scotia Supreme Court.
Crown prosecutor Janine Kidd told Justice John Bodurtha that Organ had died in the Halifax Infirmary on May 17.
Bodurtha had been set to preside at Organ’s jury trial when his lawyer, Steven Degen, told the court that his client’s health had deteriorated to the point where he was unlikely to last through a trial.
Bodurtha had the matter return to court several times to update Organ’s status, culminating in the news on Monday of his death.
Judith Organ was found dead on June 9, 2024, in the home on Agincourt Crescent she shared with Edmund Organ. At the time, police said they received a call from a man who told them he had killed a woman inside his home.
Organ was held in custody from his arrest in June 2024 until his release on conditions in August 2024.
